According to the present invention, an image encoding apparatus comprises: a motion prediction unit which derives motion information on a current block in the form of the motion information including L0 motion information and L1 motion information; a motion compensation unit which performs a motion compensation for the current block on the basis of at least one of the L0 motion information and L1 motion information so as to generate a prediction block corresponding to the current block; and a restoration block generating unit which generates a restoration block corresponding to the current block based on the prediction block. According to the present invention, image encoding efficiency can be improved.

The invention claimed is: 1. An image decoding apparatus comprising: a motion estimator generating a merge candidate list relating to a current block, determining a merge candidate for the current block based on the merge candidate list and a merge candidate index, and deriving motion information of the current block from motion information of the determined merge candidate, wherein the merge candidate list includes a plurality of merge candidates including a temporal merge candidate, and wherein the merge candidate index selects one of the merge candidates in the merge candidate list; a motion compensator generating a prediction block corresponding to the current block based on the derived motion information; and a reconstructed block generator generating a reconstructed block corresponding to the current block based on the prediction block, wherein motion information of the temporal merge candidate includes a motion vector and a reference picture index, wherein the motion vector of the temporal merge candidate is derived from a motion vector of a collocated block within a collocated picture, and the reference picture index of the temporal merge candidate is set equal to 0 regardless of the motion information of a reconstructed neighboring block adjacent to the current block, wherein the collocated picture is a reference picture having the collocated block among reference pictures included in a reference picture list, wherein an encoding mode of the current block is a merge mode, and wherein the collocated block is determined to be either a first block including a right-bottom position of the current block or a second block including a center position of the current block. 2. The image decoding apparatus of claim 1 , wherein the collocated block is determined by scanning the first block and the second block in a predetermined order. 3. The image decoding apparatus of claim 2 , wherein the scanning is performed in sequence of the first block and the second block.
