To allow a reception-side to appropriately cope with dynamic change of a distribution content, and perform correct stream reception. In a first transmission mode, a basic video stream including image data in a lowest class and a predetermined number of enhancement video streams each including image data in a class other than the lowest class constituting scalable encoded image data are transmitted. In a second transmission mode, only the basic video stream including basic image data is transmitted. Identification information for identifying the first mode and the second mode is inserted into a video stream. The reception-side can easily find the transmission mode, and the reception-side can appropriately cope with change in a stream configuration, and more specifically, the reception-side can appropriately cope with dynamic change in a distribution content, thus capable of performing correct stream reception.
