The present invention relates to novel hybrid promoters comprising a caulimovirus promoter operably linked to one or more of an EF1α, Act8, Act2 or Act11 promoter. The present invention also relates to novel DNA constructs comprising at least one expression cassette which comprises the hybrid promoter thereof. The present invention further relates to transgenic plants/seeds comprising such DNA constructs.

First claim

We claim: 1. A nucleic acid molecule comprising a nucleotide sequence comprising SEQ ID NO: 30. 2. The nucleic acid molecule of claim 1 , operably linked to a structural DNA sequence. 3. The nucleic acid molecule of claim 2 , wherein the structural DNA sequence encodes an herbicide tolerance protein. 4. The nucleic acid molecule of claim 3 , wherein the herbicide tolerance protein is a glyphosate tolerance protein. 5. The nucleic acid molecule of claim 4 , wherein the glyphosate tolerance protein is a glyphosate oxidoreductase (GOX) protein. 6. The nucleic acid molecule of claim 4 , wherein the glyphosate tolerance protein is a 5-enolpyruvyl-3-phosphoshikimate synthase (EPSPS) protein. 7. The nucleic acid molecule of claim 6 , wherein the EPSPS protein is aroA:CP4 EPSPS. 8. The nucleic acid molecule of claim 4 , wherein the structural DNA sequence encoding the glyphosate tolerance protein is further operably linked to a structural DNA sequence encoding a chloroplast transit peptide (CTP). 9. The nucleic acid molecule of claim 8 , wherein the chloroplast transit peptide is CTP2 from Arabidopsis. 10. A method of controlling weeds comprising applying to a crop plant transformed with the nucleic acid molecule of claim 4 a sufficient amount of glyphosate to control weeds without damaging the crop plant. 11. The method of claim 10 , wherein the crop plant is a monocot crop species. 12. The method of claim 11 , wherein the monocot crop is barley, corn, rice, rye, sorghum or wheat. 13. The method of claim 10 , wherein the crop plant is a dicot crop species. 14. The method of claim 13 , wherein the dicot crop is a tomato, soybean, cotton, canola or sunflower. 15. A transgenic plant comprising the nucleic acid molecule of claim 1 . 16. The transgenic plant of claim 15 , wherein the plant is a monocot crop species. 17. The transgenic plant of claim 16 , wherein the monocot crop is barley, corn, rice, rye, sorghum or wheat. 18. The transgenic plant of claim 15 , wherein the plant is a dicot crop species. 19. The transgenic plant of claim 18 , wherein the dicot crop is a tomato, soybean, cotton, canola or sunflower. 20. A transgenic plant seed comprising the nucleic acid molecule of claim 1 . 21. The transgenic plant seed of claim 20 , wherein the plant is a monocot crop species. 22. The transgenic plant seed of claim 21 , wherein the monocot crop is barley, corn, rice, rye, sorghum or wheat. 23. The transgenic plant seed of claim 20 , wherein the plant is a dicot crop species. 24. The transgenic plant seed of claim 23 , wherein the dicot crop is a tomato, soybean, cotton, canola or sunflower.
