A surgical fastener configured to close an opening in tissue is provided. The surgical fastener includes a base defining a central axis at least one pair of legs extending from the base. Each of the legs includes a base portion and a tissue engaging portion. When in a first position, each of the tissue engaging portions is arranged to define an insertion direction and when in a second position, each of the tissue engaging portions extends inward towards the central axis. The surgical fastener is at least partially formed from a shape memory material including a combination of Polydioxanone and Poly(L-lactide) or a combination of Trimethylene Carbonate and Poly(L-lactide). The pair of legs are configured to move from the first position to the second position upon activation of the shape memory material.

First claim

The invention claimed is: 1. A wound closure apparatus, comprising: an insertion instrument comprising: an elongated shaft; and an extension extending from a distal end of the elongated shaft, the extension including a tapered distal portion defining one or more vents through which suction is provided to draw tissue about the tapered distal portion; and a fastener selectively secured to a distalmost end of the extension by a frangible connection, the fastener having at least one pair of legs extending proximally towards the elongated shaft when the fastener is operably supported by the extension and being movable from a first open position to a second closed position, the fastener being at least partially formed from a shape memory material, the at least one pair of legs moving from the first open position to the second closed position upon activation of the shape memory material, wherein the fastener and the extension are monolithic. 2. The wound closure apparatus of claim 1 , wherein each leg of the at least one pair of legs includes an arcuate shape. 3. The wound closure apparatus of claim 2 , wherein each leg of the at least one pair of legs includes a point defining an insertion direction. 4. The wound closure apparatus of claim 1 , wherein each leg of the at least one pair of legs extends beyond an outer diameter of the elongated shaft. 5. The wound closure apparatus of claim 1 , wherein the legs of the at least one pair of legs are parallel to each other when the fastener is in the first open position. 6. The wound closure apparatus of claim 1 , wherein the shape memory material is temperature activated. 7. The wound closure apparatus of claim 1 , wherein the legs of the at least one pair of legs are non-parallel to each other when the fastener is in the second closed position. 8. The wound closure apparatus of claim 1 , wherein a proximal end of the tapered distal portion is disposed proximal of the at least one pair of legs of the fastener when the fastener is secured to the distalmost end of the tapered distal portion. 9. The wound closure apparatus of claim 1 , wherein the distalmost end of the tapered distal portion is disposed between the at least one pair of legs of the fastener when the fastener is secured to the distalmost end of the tapered distal portion. 10. A wound closure apparatus, comprising: a fastener; and an insertion instrument comprising: an elongated shaft configured for operable engagement by a user; and an extension extending from a distal end of the elongated shaft, wherein the fastener is integrally formed with and extends from a distalmost end of the extension, the fastener having at least one pair of legs extending proximally when the fastener is operably supported by the extension and being at least partially formed from a shape memory material, wherein the at least one pair of legs is movable from a first open position where the legs of the at least one pair of legs are parallel to each other to a second closed position upon activation of the shape memory material. 11. The wound closure apparatus of claim 10 , wherein the shape memory material is temperature activated. 12. The wound closure apparatus of claim 10 , wherein integrally formed includes monolithic.
